REItrades Privacy Policy

REItrades does not sell personal information for monetary consideration. We use and disclose information as described here to operate, secure, and improve the Platform and provide the services Users request.

This Privacy Policy explains how REItrades LLC ("REItrades," "we," "us," or "our") collects, uses, discloses, and retains personal information in connection with our websites, applications, listing and distribution tools, deal rooms, communications, and related commercial real estate services (collectively, the "Platform"). "Personal information" means information that identifies, relates to, describes, or can reasonably be linked with an individual, as defined by applicable law.

This Policy should be read together with the REItrades Terms of Use and any property-specific nondisclosure agreement or other agreement accepted through the Platform. It does not govern the privacy practices of independent brokers, closing professionals, payment processors, linked websites, or other third parties that process information under their own terms.

1. Scope

This Policy applies to visitors, applicants, registered principals and brokers, listing contacts, contributors, recipients of REItrades communications, and other individuals who interact with the Platform or whose information is provided to REItrades in connection with a business relationship. The Platform is intended for U.S. commercial and professional use and is not intended for personal, family, or household real estate transactions.

Commercial property and company information that cannot reasonably be linked to an individual may not be personal information, but access to that information may still be governed by the Terms of Use, a Property NDA, confidentiality settings, or other contractual restrictions.

2. Information We Collect

Account and professional information. We collect information such as name, business email, telephone number, company, title, user type, professional credentials or license information, login and authentication data, and information supplied in an application or account profile.

Buyer and acquisition information. We may collect company background, investment role, stated investment capacity, acquisition criteria, preferred asset classes, locations, deal size, and other information used to review access requests, maintain the buyer network, personalize marketplace results, and send relevant opportunity notifications.

Listing and property information. We process property addresses, descriptions, photographs, offering memoranda, rent rolls, financial and operating information, ownership or authorization information, marketing instructions, property codes, and other files submitted to create, manage, or distribute a Listing. Some property documents may contain information about tenants, guarantors, employees, or other individuals. The submitting User is responsible for having authority to provide that information and for redacting personal information that is not necessary for the transaction.

Deal-room and engagement information. We collect Property NDA acceptances and signatures, listing views and engagement, messages, requests, offers or letters of intent, files, contributor details, diligence activity, status updates, and other actions taken through the Platform.

Orders, payments, and closing information. We collect records of listing-service purchases, fees, refunds, invoices, payment status, and limited billing information. When a third-party payment processor handles payment credentials, the processor receives those credentials and REItrades generally receives a payment confirmation and limited transaction information. For a Platform Fee, we may receive the property, buyer entity, closing date, purchase price, payment status, settlement confirmation, and related information reasonably necessary to administer the fee.

Communications. We collect communications sent to or through REItrades, including support requests, feedback, email responses, and messages exchanged using Platform features.

Device and usage information. When you use the Platform, we may automatically collect IP address, approximate location derived from IP address, browser and device type, operating system, referral source, pages and features used, dates and times, login activity, errors, and interactions with Platform and email content.

Cookies and similar technologies. We may use cookies, pixels, local storage, and similar technologies to maintain sessions, remember preferences, secure accounts, understand use, and measure communications and campaigns. Section 6 explains available controls.

Sensitive information. The ordinary Platform does not require Social Security numbers, personal bank-account credentials, health information, biometric identifiers, or precise geolocation. Do not place such information in Listings, messages, or deal-room files unless REItrades specifically requests it through an appropriate process. If additional identity or legal verification becomes necessary, we may provide a separate notice at collection.

3. Sources of Information

We obtain information directly from you; from your company, account administrator, contributors, counterparties, brokers, or other Users; from your use of the Platform; from payment, e-signature, email, analytics, cloud, security, and other service providers; from independent brokers and closing professionals involved in a transaction; and from professional, referral, public-record, or publicly available business sources. We may combine information from these sources where lawful and reasonably necessary for the purposes described below.

4. How We Use Information

Provide the Platform. We use information to create and administer accounts, review applications, authenticate Users, publish and distribute Listings, manage property access, operate deal rooms, record Property NDA acceptance, support communications and collaboration, display engagement, process orders, and administer Platform Fees.

Personalize and communicate. We use account information, acquisition criteria, and Platform activity to display relevant properties and send service notices, listing notifications, distribution emails, follow-ups, newsletters, and information about REItrades.

Create and improve services. We use information to generate listing materials, provide support, analyze performance, troubleshoot errors, understand feature usage, develop and improve functionality, and maintain accurate business records.

Protect REItrades and others. We use information to prevent fraud and abuse, protect accounts and confidential materials, investigate security events, enforce agreements, collect amounts due, resolve disputes, comply with law, and protect the rights, safety, and integrity of REItrades, Users, and the Platform.

AI-assisted features. When a User requests or uses an AI-assisted feature, we may provide relevant Listing content and instructions to technology providers that process the information for that function. Users should not include unnecessary personal or sensitive information and remain responsible for reviewing generated materials, as described in the Terms of Use.

5. How We Disclose Information

Other Users and transaction participants. We disclose information according to Platform functions, access controls, listing instructions, and User actions. For example, a seller or listing broker may receive a prospective buyer's name, company, contact information, Property NDA acceptance, engagement, communications, and offer information. A buyer may receive seller or listing-contact information and the Listing materials made available to it. Contributors may access information available within the workspace to which they are added.

Service providers. We disclose information to providers that support hosting, storage, security, authentication, email distribution, electronic signatures, communications, analytics, artificial intelligence, customer support, document generation, payment processing, and other Platform operations. They receive information reasonably necessary to perform services for REItrades.

Independent professionals. Where reasonably necessary for a transaction or Platform Fee, we may disclose relevant information to an independent listing broker, participating broker, escrow or closing agent, payment provider, accountant, or other professional. These parties are independent from REItrades and may process information under their own legal duties and privacy practices. Their involvement does not make REItrades a broker or transaction party.

At your direction. We disclose information when you request, authorize, or direct us to do so, including through property-code sharing, team invitations, data-room permissions, communications, downloads, or integrations.

Legal, safety, and enforcement purposes. We may disclose information when we reasonably believe disclosure is required by law, legal process, a regulator, court, licensing authority, or law-enforcement request, or is appropriate to investigate misconduct, protect rights or safety, enforce agreements, or secure the Platform.

Business changes. Information may be disclosed or transferred in connection with a financing, merger, acquisition, reorganization, bankruptcy, sale of assets, change of control, or related due diligence, subject to appropriate confidentiality restrictions where practicable.

Aggregated or deidentified information. We may use and disclose information that has been aggregated or deidentified so that it cannot reasonably identify an individual. We will not attempt to reidentify deidentified information except as permitted by law to test our deidentification processes.

REItrades does not sell personal information for monetary consideration. Some privacy laws define "sale" or "sharing" broadly and may treat certain analytics, advertising, or platform disclosures as covered activity. If REItrades engages in processing that is subject to an opt-out right, we will provide and honor the legally required choice.

6. Cookies, Analytics, and Preference Signals

Cookies and similar technologies may be necessary for login, security, and core functionality or may support preferences, analytics, communications measurement, and campaign performance. You can use available cookie controls and browser settings to limit nonessential technologies. Blocking necessary cookies may prevent portions of the Platform from working properly.

Where applicable law requires recognition of a qualifying universal opt-out preference signal, such as Global Privacy Control, REItrades will treat a recognized signal as an opt-out request for the browser or device from which it is received. Because these signals are browser- and device-specific, you may need to enable them separately on each browser or device.

7. Communications Choices

You may opt out of promotional emails by using the unsubscribe link or contacting us. You may also update acquisition criteria or notification preferences through available account settings. Even after an opt-out, we may send nonpromotional communications concerning your account, security, Property NDAs, transactions, purchases, fees, requested services, legal notices, or material Platform changes.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including maintaining accounts and Listings, providing requested services, preserving Property NDA and electronic-signature records, administering fees, maintaining security and audit records, complying with legal or contractual obligations, resolving disputes, and enforcing agreements. Retention periods depend on the type of information, the relationship, the sensitivity of the data, and applicable requirements.

Closing an account or deleting a Listing does not necessarily delete all associated information. We may retain transaction, payment, confidentiality, dispute, security, backup, and compliance records where permitted or required. When information is no longer reasonably needed, we may delete, deidentify, or aggregate it.

9. Security

REItrades uses administrative, technical, and organizational safeguards designed to protect personal information in light of its nature and the risks involved. No system, storage method, or transmission is completely secure, and we cannot guarantee absolute security. Users are responsible for protecting credentials, limiting access to property codes and restricted links, reviewing team permissions, and notifying support@reitrades.com promptly of suspected unauthorized activity.

10. Privacy Rights and Requests

Depending on your state of residence, the law that applies, and available exemptions, you may have rights to confirm whether we process your personal information; access or obtain a copy; correct inaccuracies; request deletion; obtain portable data; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive information; withdraw consent where processing is based on consent; and appeal a denied request. You may also have the right not to receive unlawful discriminatory treatment for exercising a privacy right.

Many state consumer-privacy laws exclude or limit rights for information processed in a business, employment, or commercial context. We will apply rights as required by applicable law and may honor requests voluntarily when reasonably practicable. Rights are subject to exceptions, including information needed to provide a requested service, complete a transaction, secure the Platform, comply with law, exercise legal rights, preserve privileged material, or maintain required records.

Submitting a request. Email support@reitrades.com with the subject line "Privacy Request" and state your name, account email, company, state of residence, and the right you wish to exercise. Do not send government identification or sensitive documents unless we specifically request them through a secure method.

Verification. We may verify a request using information associated with your account or business relationship. If we cannot reasonably verify identity or authority, we may deny or limit the request. An authorized agent may submit a request where permitted, but we may require proof of authority and direct confirmation from the individual.

Appeals. If applicable law provides a right to appeal, you may appeal a denied request by replying to our decision or emailing support@reitrades.com with the subject line "Privacy Appeal." We will respond within the period required by applicable law.

11. Supplemental U.S. State Disclosures

During the twelve months preceding the Effective Date, depending on the relationship and Platform use, REItrades collected the following categories of personal information: identifiers and contact information; account credentials; professional and employment-related information; commercial, listing, order, and transaction information; internet and electronic-network activity; approximate geolocation; communications and User Content; preferences and inferences concerning acquisition interests; and limited sensitive information such as account login credentials or verification information when provided.

The sources are described in Sections 2 and 3, the purposes in Section 4, and the categories of recipients in Section 5. These categories may have been disclosed for the business purposes described in this Policy to service providers, other Users and transaction participants, independent professionals, and legal or corporate recipients. REItrades does not sell personal information for monetary consideration, does not offer a financial incentive in exchange for personal information, and does not knowingly sell or share personal information of individuals under sixteen.

12. Information Submitted by Business Users

When a User submits personal information about another individual through a Listing, deal room, communication, or other Platform feature, REItrades processes that information to provide the requested Platform functions. The submitting User is responsible for having authority to provide it. A privacy request concerning that information may require coordination with the submitting User or other responsible business.

13. International Access

REItrades is based in the United States, and the Platform is directed to the U.S. commercial real estate market. If you access the Platform from another country, your information may be transferred to and processed in the United States and other locations where service providers operate, which may have different data-protection laws. We use protections required by applicable law when such requirements apply to our processing.

14. Children

The Platform is not directed to individuals under eighteen, and REItrades does not knowingly collect personal information from them. If you believe a minor has provided personal information, contact us so we can review and take appropriate action.

15. Third-Party Services and Links

The Platform may contain links to or integrations with third-party services. This Policy does not apply to information a third party processes under its own authority. Review the third party's privacy notice before providing information or using its service. REItrades is not responsible for another party's privacy or security practices.

16. Changes to This Policy

We may update this Policy to reflect changes in the Platform, our practices, or applicable requirements. We will post the revised Policy with a new Effective Date and provide additional notice of material changes when reasonably appropriate or legally required. Changes apply prospectively unless otherwise stated or permitted by law.
